CorePower Yoga Messaging Terms & Conditions

By opting into the CorePower Yoga text messaging program (the "Text Program"), I agree to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages (e.g. cart reminders, class offers & sweepstakes) from CorePower Yoga, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number I provided when signing up or any other number that I designate. Consent to receive automated marketing text messages and participate in the Text Program is not a condition of any purchase. Msg & Data rates may apply.

Message frequency in the Text Program will vary. CorePower Yoga reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. CorePower Yoga also reserves the right to change the short code or phone number from which messages are sent and we will notify you when we do so.

Not all mobile devices or handsets may be supported and our messages may not be deliverable in all areas. CorePower Yoga, its service providers and the mobile carriers supported by the program are not liable for delayed or undelivered messages.

By opting into the Text Program, I also agree to CorePower Yoga Student Terms & Conditions, CorePower Yoga Terms of Use and CorePower Yoga Privacy Policy. The CorePower Yoga Messaging Terms & Conditions are in addition to and not in lieu of the Student Terms & Conditions, the Terms of Use and the Privacy Policy.

The CorePower Terms of Use include an Arbitration Agreement with Class Action Waiver that also applies to these Messaging Terms & Conditions and the Text Program. Please review it carefully as it replaces the right to go to court and the right to have a jury decide a dispute. It substantially affects your rights, including preventing you from bringing, joining or participating in class or consolidated proceedings.

I understand that I must be the mobile telephone account holder and at least 18 years of age or have a parent or guardian's permission in order to participate.

CorePower Yoga is able to deliver messages to the following mobile phone carriers: Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile. Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

Cancellation

Text the keyword STOP, END, CANCEL, UNSUBSCRIBE or QUIT to CorePower Yoga's shortcode to cancel. After texting STOP, END, CANCEL, UNSUBSCRIBE or QUIT to CorePower Yoga's shortcode you will receive one additional message confirming that your request has been processed. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that do not include the STOP, END, CANCEL, UNSUBSCRIBE or QUIT keyword commands and agree that CorePower Yoga and its service providers will have no liability for failing to honor such requests. If you unsubscribe from one of our text message programs, you may continue to receive text messages from CorePower Yoga through any other programs you have joined until you separately unsubscribe from those programs.

By providing my information and opting into the Text Program, I confirm that I have read and consent to the terms of this eSignature Notice. My consent to this eSignature Notice applies to the CorePower Yoga Messaging Terms & Conditions and any other notices, disclosures, agreements, contracts, records, receipts, statements, notifications, terms of use, and other information (collectively, “Information”) related to CorePower Yoga, which will be distributed to me in electronic form and not in paper form. This consent will remain effective for the duration of CorePower Yoga’s provision of service to me and/or my participation in the Text Program, unless and until expressly withdrawn by me. My consent does not mean that CorePower Yoga must provide Information electronically but instead that it may deliver some or all of the Information electronically. I may request a paper version of the Information. I acknowledge that CorePower Yoga reserves the right to charge me a reasonable fee for the production and mailing of paper versions of the Information. I am responsible for the installation, maintenance and operation of my mobile device, browser and software. CorePower Yoga only requires, at minimum, that I have a working mobile device with a mobile browser and modern apps that can access CorePower Yoga’s website (such as a recent version of Apple Safari, Mozilla Firefox, or Google Chrome) and open common file formats of Information that it may send (for example, Microsoft Word, PDF, or a text file) running on an up-to-date operating system (such as iOS or Android). Unsupported apps, browsers or operating systems may not function properly. CorePower Yoga is not responsible for errors or failures from any malfunction of my mobile device, browser or software.

Indemnification

In addition to any other indemnification obligations you have as set forth in the CorePower Yoga Terms of Use and the CorePower Yoga Student Terms and Conditions, you agree to indemnify, defend, and hold CorePower Yoga and its and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use from any third party claims, liability, damages or costs arising from your use of the Text Program or from you providing us with a mobile phone number that is not your own.

Limitation on Liability

IN ADDITION TO ANY LIMITATIONS ON OUR LIABILITY AS SET FORTH IN THE COREPOWER YOGA TERMS OF USE AND THE COREPOWER STUDENT TERMS AND CONDITIONS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS, COREPOWER YOGA IS NOT RESPONSIBLE OR LIABLE IN ANY MANNER FOR FAILED, DELAYED, OR MISDIRECTED DELIVERY OF ANY INFORMATION SENT THROUGH THE TEXT PROGRAM, ANY ERRORS IN SUCH INFORMATION, AND/OR ANY ACTION YOU MAY OR MAY NOT TAKE IN RELIANCE ON THE INFORMATION OR TEXT PROGRAM.

CorePower Yoga Text Program Terms & Conditions

The CorePower Yoga Text Program is operated by our vendor, Klaviyo. Your use of the CorePower Yoga Text Program constitutes your agreement to the CorePower Yoga Text Program Terms & Conditions. We may modify or cancel the CorePower Yoga Text Program or any of its features without notice. To the extent permitted by applicable law, we may also modify the CorePower Yoga Text Program Terms & Conditions at any time and your continued use of the CorePower Yoga Text Program following the effective date of any such changes shall constitute your acceptance of such changes.

When you sign up for the CorePower Yoga Text Program, you agree to receive recurring SMS/text messages, both service-related messages and promotional messages, from and on behalf of CorePower Yoga through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Service-related messages may include updates, alerts, and other information (e.g., information about Activities you have registered or signed up for, purchases, account alerts, etc.). Promotional messages may include promotions, specials, and other personalized marketing offers or messages (e.g., cart reminders, class offers & sweepstakes). You agree that SMS/text messages may be sent using equipment that automatically selects and/or dials numbers or other technology.

We do not charge for the CorePower Yoga Text Program, but you are responsible for all charges and fees associated with SMS/text messaging imposed by your wireless provider. Check your mobile plan and contact your wireless provider for details. Message frequency varies, and message and data rates may apply. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider. Carriers are not liable for delayed or undelivered messages.

You understand that you do not have to sign up for the CorePower Yoga Text Program in order to make any purchases or participate in any Activities. Your consent is not a condition of any purchase and your participation in the CorePower Yoga Text Program is completely voluntary.

You may opt-out of the CorePower Yoga Text Program and stop receiving text messages from us at any time by texting STOP to 62038 or replying STOP to any text from us. After opting-out, you will receive a one-time opt-out confirmation text message, but then no other messages will be sent to your mobile device, unless initiated by you.
